We will list your current Denver metro area home for free, if you also use us as your buyer agent for your new Denver metro area home, and the price of the replacement home is $350,000 or more! If the price of the replacement home is less than $350,000, then the listing side commission would be just 1.2% vs the 2.7%-3% most brokerages charge, which is still a substantial saving!

Terms and Conditions:

This offer will require the consumer to simultaneously execute an exclusive right to sell listing contract for the current home, and an exclusive right to buy agency contract with Ron Goodman and Denver Home Value Realty, which will formalize these terms as described below.

This offer is limited to real estate brokerage listing side services and commissions only. Seller shall be solely and entirely responsible for all other normal selling expenses, closing costs and fees. The Seller will pay 2.8% buyer agent commission plus 2.7% listing side commission on closing of sale of their current home. If the replacement home purchase price is $350k or greater, then the full 2.7% listing side commission will be credited toward allowable closing costs and prepaids on their new Denver Metro area home at its closing. If the replacement home purchase price is less than $350k, then the 1.5% difference between the 2.7% listing fee and 1.2% discounted fee will be credited toward allowable closing costs and prepaids on their new Denver Metro area home at its closing. The 2.8% buyer agent commission will be paid by seller to the buyer’s real estate broker at closing, as a normal seller closing cost. All seller closing costs, including commissions and the commission rebate, will be reported on the final HUD-1, as required by the lender and federal laws.

If a replacement home purchase does not close for any reason after the sale of the previous home, then the 2.7% commission earned from the sale of the previous home will be retained by us until such time as a successful purchase is accomplished, except as follows: If a successful purchase cannot be accomplished within 90 days of sale of the previous home, then the 2.7% listing side earned commission will be retained by us, with no subsequent credit due to the consumer.

At or before the execution of the listing agreement, the consumer must provide us with written proof of prequalification for a mortgage loan. This may be from any one of several lenders that can be referred by us, or with any other local “brick and mortar” lender of consumer’s choice. Prequalification for a loan for the replacement home may be contingent on successful sale of the current home. Internet and other online lenders who do not have a physical office in the Denver metro area do not satisfy this requirement. We will only visit potential replacement homes that are priced within the consumer’s prequalified price range.

While we will make every reasonable effort to market and sell the consumer’s current home, due to current market conditions and other factors outside of our control, such sale is not guaranteed. To facilitate sale of consumer’s current home, the following list pricing policy shall apply: Listing price will be not more than 3% over the suggested listing price that we will provide in writing to the consumer, which will be based on a formal, detailed, written Comparative Market Analysis. Or, list price will be not over the appraised value as established by an an appraiser licensed in the State of Colorado and hired by seller, provided that the appraisal shall not be more than 6 months old, and the appraisal shall not be one that was used for refinancing or potential refinancing purposes. Such appraisals are notoriously inaccurate, and often do not represent the true current market value of the property.

If the replacement home will be a builder new-build or spec home, then the consumer must be accompanied by one of our team agents and register at the builder’s on-site sales office with that agent as their buyer agent on their first visit to the builder community. For a pre-owned listed home, the consumer must use us for all home showings and offers.

These and other terms and conditions may be negotiated and will be documented in writing in the applicable exclusive right to sell listing agreement and/or exclusive right to buy agency agreements. Agent and brokerage reserve the right to decline to execute a contract with the consumer for any reason, including but not limited to: the condition and/or marketability of the current property, if the listing price would result in a short sale (where the seller’s proceeds after closing costs would be insufficient to satisfy all outstanding mortgages and other liens), consumer’s refusal to list at a price conforming to our list pricing terms as specified above, consumer’s inability to qualify for a mortgage loan for the new home, or any other reason, at our sole discretion.
